In the recent conference on real estate held in New Delhi, officials from the Real Estate Regulatory Authority (RERA) strongly urged builders to follow real-world advertising strategies and follow the guidelines that are in the Real Estate (Regulation and Development) Act, also known as RERA.
It was a clear message for the government. False advertisements, misleading promises, and insufficient information about property cannot be tolerated within the Indian real property market.
RERA Officials Stress Transparency in Real Estate Advertising
At the event, Anand Kumar, Chairman of Delhi RERA, emphasized that real estate developers should ensure that their advertisements depict the exact property and the amenities provided. According to him, disputes between builders and buyers result from advertisements that set unrealistic expectations.
He said that advertising should be accurate, honest, and supported by solid information. Builders are advised to mention all important information, like carpet area, covered area specifications, approvals, and timeframes for possession. He also advised that developers should not promote projects solely by referring to "super area," as this can lead buyers to be confused about the usable space within the property.
For a long time, consumers in India have encountered issues in which the amount of space promised by developers varied in significant ways from the actual usable space at the time of possession. RERA has now asked developers to emphasize transparency to ensure that buyers make informed decisions about investments without confusion.
Assured Return Schemes Under Scrutiny
One of the main concerns mentioned by RERA representatives was the increasing popularity of "assured return" schemes in the real property market. Numerous developers entice buyers by offering fixed monthly or annual returns on investments in property. Although these promises may seem appealing, RERA officials warned that these schemes cannot be permitted if they infringe on legal regulations or deceive buyers.
Anand Kumar clearly stated that financial incentives need to be transparent and in compliance with RERA regulations. Buyers should not be enticed into buying projects with unrealistic promises of guaranteed returns or profits.
In recent times, many investors have experienced losses because certain builders did not meet the promised return obligations following delays to projects or financial difficulties. RERA authorities believe that a more rigorous monitoring of these ads will ensure that consumers are protected from risks in the future.
Importance of Registered Agreement for Sale
Another key issue discussed during this conference is the rules about advance payments by buyers. According to RERA rules, developers are not able to receive at least 10% of the property's cost before signing a contract of sale.
This law was introduced as a crucial safeguard for buyers of homes. It guarantees buyers legal protection prior to paying a substantial amount for the construction company. RERA officials reminded builders that violating the rule could result in strict disciplinary action.
The authorities also urged buyers to know the rights they have under RERA prior to purchasing any property. The awareness among buyers is crucial for reducing conflicts and increasing trust in the real estate market.
Buyers Advised to Verify Ownership Structures
RERA officials have also expressed concern about the growing popularization of "virtual space" selling and fractional ownership models. These models of investment allow multiple buyers to hold part of residential or commercial properties. These types of investment models are getting more popular with investors, and the authorities have warned potential purchasers to verify the legal ownership structure before investing funds.
Many experts believe that buyers invest in these investments without fully knowing their rights of ownership, exit policies, or legal obligations. RERA advised investors to read every document carefully and verify that the structure of the investment is in line with legal requirements.
Uttar Pradesh RERA Highlights Positive Impact of Regulation
Sanjay R Bhoosreddy, Chairman of Uttar Pradesh RERA, also said that regulatory reforms have substantially enhanced the performance of the residential real estate industry in recent times. According to him, enforcement measures have helped increase the protection of consumers and accelerate the completion of projects.
He pointed out that the real estate market contributes around 12-13% to gross state domestic product (GSDP) from Uttar Pradesh, which is much higher than the average for the country. Transparency and oversight by the regulator have contributed to boosting the confidence of buyers in the real estate market.
Bhoosreddy stated that the number of disputes that are filed each day before the authorities has decreased dramatically over the last two years. This means that developers are becoming more observant of RERA regulations and the standards of project delivery.
Rise in Project Registrations Reflects Market Confidence
This Uttar Pradesh RERA chairman also disclosed important data on registrations for projects. According to his report, the number of approved real estate projects has grown dramatically over the past few years.

About 197 projects were registered by 2023.

Around 259 projects were approved in 2024.

More than 308 new projects had been approved by 2025.
The official added that registrations for this year's calendar have already surpassed 100 projects, and could reach 400 at the end of the year.
